LITTLE ROCK, Ark. (AP) - Attorney General Dustin McDaniel is appealing a federal judge's decision striking down an Arkansas law that banned most abortions 12 weeks into a woman's pregnancy.
McDaniel filed a notice of appeal Friday over U.S. District Judge Susan Webber Wright's ruling that the abortion prohibition was unconstitutional and violated the 1973 Roe v. Wade decision. Wright left in place a portion of the law that requires doctors to check for a fetal heartbeat and to notify the pregnant woman if one is present.
The sponsor of the 12-week ban said earlier Friday that McDaniel had said he planned to appeal the decision.
The majority-Republican Legislature approved the ban last year, overriding a veto by Democratic Gov. Mike Beebe. Beebe had called the measure unconstitutional.Copyright 2014 The Associated Press. All rights reserved. This material may not be published, broadcast, rewritten or redistributed.
