McDaniel expresses disappointment at drug ruling

LITTLE ROCK, Ark. (AP) - Arkansas Attorney General Dustin McDaniel says he is disappointed in an Arkansas Supreme Court decision that threw out a $1.2 billion judgment the state won in a lawsuit over marketing of an antipsychotic drug.

The high court on Thursday ruled that the state misapplied the Medicaid fraud law in its suit against Johnson & Johnson and a subsidiary over the drug Risperdal.

McDaniel issued a statement saying he'll continue working to protect the public from fraud and "greedy actions" but he didn't say whether he'd explore bringing an appeal or another lawsuit against the drugmaker.

The state sued the companies in 2007, arguing that they downplayed and concealed risks of the drugs and lied to doctors for years about its side effects.
