LITTLE ROCK, Ark. (AP) - Prosecutors say they will seek a third trial for a former Little Rock police officer who is charged with manslaughter for the shooting death of a 15-year-old boy he caught breaking into cars.
Two juries have deadlocked this year on whether Josh Hastings acted appropriately when he fired into a car, killing Bobby Moore III.
Prosecutor Larry Jegley said Friday that his office will try once more for a conviction. Hastings' attorney, Bill James, said he doesn't plan to do much differently in a new trial.
The judge set May 5 for the start of a new trial.
Hastings claims Moore's car was heading toward him when he fired but prosecutors say Hastings shot unnecessarily and that evidence conflicts with Hastings' story.Copyright 2013 The Associated Press. All rights reserved. This material may not be published, broadcast, rewritten or redistributed.
