Retailers to be heard as wine lawsuit heads to federal court

A lawsuit over wine sales in Arkansas will now go to federal court, with four big retailers now asking to intervene.

Kroger, Walmart, Sam's and Hays Food Town stores say they have an active interest in the pending suit as they have applied for permits under Act 508, which clears the way for grocery stores to sell wine other than those from small farm wineries.

Earlier this month, four liquor store groups filed suit in Pulaski County against the director and commissioners of the Alcohol Beverage Control Board to challenge the act.

Among other arguments, attorneys for the liquor store groups argue the act conflicts with current state law and violates the equal protection clause of the Arkansas and the U.S. Constitution.

The hearing is set for November 13. The retailers will have the opportunity to be heard regarding the suit.
